Terms and services
By commissioning me in any kind of way, you are agreeing to the terms of service mentioned below, even so, any statement can be bound to change if discussed with me, the artist, prior to the commission
If the client did not read the terms and services, I, the artist will not be held accountable for any misunderstandings.
i. General Terms

Please write in a clear and nice manner.

Provide references, not just a wall of text.

Any ill behavior will not be tolerated and your commission will be canceled if it occurs.

If I am not comfortable with the order, I have the right to decline it.
ii. Payment Terms
There are two options for payment:

50% of the price will be payed after I deliver a rough sketch of the piece, this applies to all commissions. If the client decides to cancel the commission after the first payment or when the second payment is required, there will be no refund.

The client can pay full in before I start on the commission. Refund will apply here

Payment will be through transfer only, I will provide the details for said transfer after discussing what the client wants as commission and after I accept to take said commission.
Tips are greatly appreciated but also not necessary.
iii. Cancellation and Refund Terms

Refunds and cancellations are accepted as long as it is reasonable, however there will be a penalty as seen below:

If the client cancels the commission when I have finished the lineart phase, clients will be refunded 20% of their payment.

If the client cancels the commission when I have started coloring, clients will be refunded 10% of their payment.

The clients has no right to cancel or demand a refund from the artist under any circumstances after the finished artwork is received.

If I, the artist, cancel the commission, the client will be fully refunded. This only applies if the client pays in full before starting the commission.

If the money has not been sent after sending the rough sketch (50% payment) or before starting (full payment), the artist has the right to cancel the commission.
iv. Copyright and Usage Policy

You cannot claim, edit, reproduce my artworks and/or use them for commercial purposes (monetized videos, merchandise, prints, books, etc). Especially do not use it for NFT.

Do not take credit for my work or remove my watermark in any case as this will be considered copyright infringement.

I, the artist, hold every right to the produced drawing, not the commissioner, therefore I'm allowed to use the copyrighted artwork to do the following:

Promote myself with in any place or site.

Publish books with.
-
Use it as part of my portfolio
-
To display it anywhere to my liking.
-
Post it wherever I want. (If you don't want your commissioned piece to be published or the publishing to be postponed to a later time, please negotiate with me).

Clients can only use commissioned artworks for personal usages unless an extra commercial fee is payed.

The client can claim the right to their character(s) but not the drawing itself.
-
The client can use the art to promote themselves with proper credit given to the artist.
-
If you, the client, break the copyright infringement in any way, every right you had to the drawing will be retracted.
v. Customer Satisfaction
I will do everything I can to make my customers happy.

However after a commission is finished, only small changes such as small colouring/marking mistakes are allowed to be made.

Any great changes will come with an extra charge if it implies changing more than 40% of the piece when it is about 60-70% completed.

This implies an outfit change, outfit addition or subtraction, background change or anything that makes me have to redraw it completely. This does not apply when it's still in the sketching phase.

If your reference was unclear to start with, then you are not allowed to do minor changes without a fee.

Make sure to be clear in your order what you aim for.
vi. Process
The time for your commission to be completed can be up to 3 months depending on many factors such as;

Health, order of commission, complexity, Work, school or family issues.

If any of the things stated above occurs you will be notified asap. If by any reason you have not been alerted, contact me through instagram or email.
vii. Commercial Rights

A Purchase of Commercial rights to the artwork will always be 200% of original price.

With commercial rights you are allowed to make any sort of merch with the artwork including using it in books, covers, as props, changing it to your liking and promoting your own brand with.

Credit is still required for usage of the artwork, even if altered or edited.
If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers.

You will forbidden to ever commission me, Alkaemyy, ever again.
-
Your name will be publicly posted everywhere I want to for others to watch out for.
-
I also have every right to file a complaint and I have all the right to the money you have given me.
Any statement can be bound to change if discussed with me, the artist, prior to the commission.
